Preventing Statelessness in the US: Act Now
Statelessness is the condition of not being “considered as a national by any State under the operation of its law,” leaving individuals without a legal nationality, cutting them off from work, education, healthcare, and basic protections. A 2020 study found that many foreign-born US residents are at risk, including children born in countries without birthright citizenship and those whose nationalities have been revoked by authoritarian governments.
The Fourteenth Amendment has safeguarded birthright citizenship and protected against statelessness for generations. However, an Executive Order aiming to eliminate birthright citizenship threatens this foundation. While currently blocked in court, it must be rescinded.
Congress must also take action by passing legislation, such as the Stateless Protection Act of 2024, to provide work and travel authorization and a path to permanent status for stateless individuals.
